Luis Abreu Elías, el abogado de Elma Beatriz 
Rosado, viuda del fundador del Ejército Popular 
Boricua-Los Macheteros, Filiberto Ojeda Ríos, 
reclamó al designado secretario de Justicia, 
Antonio Sagardía, que reabra la pesquisa estatal 
por la muerte a manos de agentes federales del líder separatista.

El reclamo surge a la luz de que apareciera un 
memorando confidencial del Departamento de 
Justicia del 31 de enero de 2008 -revelado 
inicialmente por el servicio de noticias NCN el 
pasado jueves- que concluía que la muerte de 
Ojeda Ríos “puede configurar el delito de 
asesinato”, una versión distinta al informe que 
el ex secretario de Justicia, Roberto J. Sánchez 
Ramos, reveló al País el 9 de abril de 2008 que 
sólo menciona en su conclusión que “la prueba 
recopilada por este Departamento es insuficiente 
para establecer (
) que uno o más de los 
oficiales concernidos incurriesen en conducta criminal”.

Además, Elías aseguró que él sabe que el personal 
forense y los fiscales estatales que estuvieron 
en la casa de Ojeda Ríos el día de su muerte 
pueden proveerle a Sagardía nueva información que 
conllevaría a la acusación criminal del agente 
del Negociado Federal de Investigaciones (FBI) 
que disparó el tiro mortal contra el líder 
machetero, identificado por el seudónimo “Brian”.

“Yo no creo que el PNP (el gubernamental Partido 
Nuevo Progresista) haga nada. Yo sí espero del 
secretario de Justicia que se tome la iniciativa 
de entrevistar a los inspectores forenses y a los 
fiscales, que lea este informe (el nuevo borrador 
del cual El Nuevo Día tiene copia), que 
rectifique y haga un nuevo informe”, dijo Elías.

Según Elías, de sus conversaciones con estos 
funcionarios surge una descripción física de 
Brian como un hombre rubio, fornido, de pelo 
corto estilo militar. El abogado criminalista 
explicó que la descripción física que pueden 
surgir de esas entrevistas permitiría a la 
Policía hacer un boceto del agente, con la 
consecuente radicación de cargos criminales en ausencia.

El letrado aseguró que esos testigos también 
dirían que escucharon a otros agentes federales 
felicitar a Brian por lograr herir a Ojeda Ríos, 
lo que según Elías contradice la versión oficial 
del FBI de que no sabían si el líder machetero estaba herido.

El FBI en todo momento ha dicho que actuó de 
forma apropiada ante las circunstancias.

El informe oficial de Justicia del 9 de abril de 
2008 decreta “el cierre y archivo de este asunto” 
a menos que “se proceda con su reapertura de 
accederse a prueba adcional o distinta”.
Aunque la primera pesquisa de la Oficina del 
Inspector General que falló a favor del FBI sobre 
la muerte del líder machetero se hizo bajo la 
presidencia del republicano George W. Bush, la 
entrada del demócrata Barack Obama a Casa Blanca 
no debe significar que se reinvestiguen la muerte de Ojeda Ríos, según Elías.

Luis Abreu Elías, attorney for Elma Beatriz 
Rosado, widow of the founder of the Boricua 
Popular Army–The Macheteros, Filiberto Ojeda 
Ríos, appealed to the Antonio Sagardía, nominee 
for Attorney General, to reopen the state’s 
investigation into the death of the separatist 
leader at the hands of federal agents.

The demand comes to light just as a Department of 
Justice confidential memorandum January 31, 2008, 
was unearthed initially revealed by the news 
service NCN [sic] last Thursday that concluded 
that Ojeda Ríos’ death “could constitute the 
crime of murder,” a different version of the 
report which the former Attorney General, Roberto 
J. Sánchez Ramos, revealed to the country of 
April 9, 2008, which mentions in its conclusion 
only that “the evidence gathered by this 
Department is insufficient to establish (...) 
that one or more of the federal officials 
involved committed criminal conduct in carrying out the operation.”

Elías also assured that he knows that the 
forensic personnel and the state prosecutors who 
were in Ojeda Ríos’ house the day of his death 
can provide Sagardía with new information that 
would lead to criminal charges against the 
Federal Bureau of Investigation (FBI) agent, 
identified by the pseudonym “Brian,” who fired 
the fatal shot at the Machetero leader.

“I do not believe that the NPP (the governmental 
New Progressive Party) will do anything. I do 
hope that the Attorney General will take the 
initiative and interview the forensic inspectors 
and the prosecutors, that he will read this 
report (the new draft which El Nuevo Día has a 
copy of), that he will rectify the situation and 
make a new report,” said Elías.

According to Elías, from his conversations with 
those functionaries emerges a physical 
description of Brian as a blond, muscular man 
with a military style haircut. The criminal 
defense lawyer explained that the physical 
description that may emerge from these interviews 
could allow the Police to make a sketch of the 
agent, with the consequent filing of criminal charges in absentia.

The attorney assured that these witnesses could 
also say that they heard other federal agents 
congratulating Brian for having wounded Ojeda 
Ríos, which, according to Elías, contradicts the 
FBI’s official version that they did not know if 
the Machetero leader was wounded.

The FBI has always said that it acted appropriately under the circumstances.

The April 9, 2008, official report of the Justice 
Department decreed “that this matter be closed,” 
but that “it may be reopened in the event that 
additional or different evidence is obtained.”

Although the first investigation of the Office of 
Inspector General that ruled in favor of the FBI 
in the death of the Machetero leader was done 
under the Republican presidency of George W. 
Bush, the coming of Democrat Barack Obama to the 
White House does not mean that the death of Ojeda 
Ríos will be reinvestigated, according to Elías.
